Learn how to claim Form 1116 for Indian tax paid: FTC limits, NRO interest, PFIC mutual funds, NIIT, Form 67 vs 44, plus worked examples for NRIs.
If you're an NRI, an H-1B holder, or a green card holder paying tax in both India and the US, you've probably run into the same wall: India taxes your salary, your NRO interest, or your dividends, and then the US wants its cut too. Form 1116 is how you stop that double bite. It lets you claim a US foreign tax credit for the income tax you already paid to India, so the same rupee doesn't get taxed twice.
This guide walks through who needs to file, how the credit limit is actually calculated, what trips people up (PFIC mutual funds and NIIT, mostly), and two worked examples with real numbers.
Form 1116 is the IRS form you use to claim a foreign tax credit against US tax owed on income earned abroad. It lives in the US Internal Revenue Code, mainly Sections 901, 904, and 27(a). The current version is the 2025 revision, and it's a US filing only, not something connected to Indian tax law.
The Indian side of the equation runs on a completely separate track. For income earned in FY 2025-26 or earlier (that's Assessment Year 2026-27 or before), Sections 90 and 91 of the Income-tax Act, 1961, along with Form 67, govern your Indian credit for foreign tax paid. Starting with income earned in Tax Year 2026-27 (from 1 April 2026), that shifts under the new Income-tax Act, 2025: the equivalent relief moves to Sections 159 and 160, and Form 67 is renumbered as Form 44. Filing one of these forms doesn't excuse you from the other. You generally need both if you want credit recognized in both countries.

There's a middle case worth knowing: you can use Form 2555 to exclude your wages and Form 1116 to credit tax on your interest and dividends, in the same tax year. You just can't apply both benefits to the exact same dollar of income.
The core formula. Your credit is capped at your total US tax before credits, multiplied by (foreign-source taxable income ÷ total taxable income), and this is computed separately for each income category. Someone with mostly salary income and someone with mostly interest income can land on very different limits, even with identical Indian tax bills.
The de minimis exception. If your total foreign tax is $300 or less ($600 if married filing jointly), all of it is passive income reported on a 1099, you can skip Form 1116 entirely and claim the credit directly. Above that amount, filing is required.
Carryback and carryforward. An unused credit isn't gone for good. You can carry it back one year or forward up to ten years, tracked separately by category on Schedule B (Form 1116).
What's new for 2025. Part IV of Form 1116 (lines 25 through 32) must now be completed even if you're only filing one Form 1116, a change from earlier years. Separately, a new $6,000 deduction for filers 65 and older (available 2025 through 2028, under recent legislation) needs to be excluded from your taxable income when you compute the limitation on line 18. Don't just pull your Form 1040 taxable income figure straight over.
NRO fixed deposit interest and TDS. Indian banks withhold 30% TDS on NRO fixed deposit interest by default, under Section 195 (soon to be renumbered as Section 393 under the new Act). If you file Form 10F along with a US Tax Residency Certificate in advance, the India-US DTAA under Article 11 caps that withholding at 15% instead. Indian mutual funds and the PFIC trap. Most Indian mutual funds count as Passive Foreign Investment Companies (PFICs) under US tax law, and a lot of India-focused guides skip this entirely. Once your holdings cross $25,000 for single filers or $50,000 for joint filers, you need a separate Form 8621 for each fund, taxed under Section 1291 or through a Mark-to-Market election. Indian tax paid can still support a foreign tax credit claim here, but it flows through the PFIC computation, not a simple Schedule D entry.
NIIT: the tax the credit doesn't reach. If your Modified Adjusted Gross Income crosses $200,000 (single) or $250,000 (married filing jointly), the 3.8% Net Investment Income Tax applies to your Indian interest, dividends, rent, and capital gains. Form 1116 only offsets regular Chapter 1 income tax, not NIIT, which sits under Chapter 2A. There are ongoing court cases (Christensen and Bruyea, argued before the Federal Circuit in March 2026) testing whether treaty language can extend a foreign tax credit to NIIT under the France and Canada treaties specifically. Whether that reasoning would ever apply to India's treaty is unresolved, so don't build your current-year return around an assumption either way.
AMT interaction. If you have significant equity compensation, you may trigger the Alternative Minimum Tax. Its foreign tax credit runs through a separate Form 1116 computation under Section 59(a), using its own definition of foreign-source income.
Getting this split wrong throws off your limitation fraction, since the formula runs separately for each category, and it can quietly shrink your available credit.
General category: salary, wages, and self-employment or consulting income from Indian sources.
Passive category: NRO interest, dividends, most capital gains, and rental income.
Example 1: Suresh, the straightforward case.
Suresh is single, on an H-1B visa, living in Texas. His NRO fixed deposit in Pune paid ₹4,00,000 in interest for the year. Because he'd filed Form 10F and his Tax Residency Certificate ahead of time, his bank applied the reduced 15% DTAA rate and withheld ₹60,000 in TDS.
Using an illustrative rate of ₹85 to the dollar (always check the actual IRS-accepted rate for your own tax year, not this example), his interest converts to $4,706 and his Indian tax paid comes to $706. That's above the $300 single-filer threshold, so he has to file Form 1116. Say his total taxable income for the year is $95,000, and his total US tax before credits is $14,500.
His FTC limit works out to $14,500 × ($4,706 ÷ $95,000) = $718. His actual tax paid, $706, comes in under that limit, so he claims the full $706 as a credit on Schedule 3, line 1. Nothing carries forward.
Example 2: Priya, the more complicated case.
Priya and her husband are both green card holders living in New Jersey, earning $260,000 combined in wages. Priya's NRO fixed deposit in Chennai paid ₹10,00,000 in interest. She never got around to filing Form 10F, so her bank withheld the full 30%, or ₹3,00,000.
At the same ₹85/USD rate, her interest is $11,765 and her Indian tax paid is $3,529. Say their total taxable income is $220,000 and their total US tax before credits is $34,000.
Her FTC limit comes to $34,000 × ($11,765 ÷ $220,000) = $1,818. She paid $3,529, well above that limit. She can only claim $1,818 as a credit this year, and the remaining $1,711 carries back one year or forward up to ten, tracked on Schedule B.
There's a second issue here too. Their combined Modified Adjusted Gross Income of roughly $271,765 crosses the $250,000 joint NIIT threshold by about $21,765. NIIT applies at 3.8% of the smaller of that excess or their net investment income, which works out to 3.8% × $11,765 ≈ $447, owed in cash with no foreign tax credit to offset it.
There's no online portal for this. Form 1116 gets filed along with your federal return, either on paper or through tax software. Here's the process:
Sort your income by category. Salary is general category; interest, dividends, rent, and most capital gains are passive category.
Convert rupees to dollars. Use the spot rate for one-off transactions, or a consistently applied annual average for recurring income like salary or interest.
Total your foreign tax paid for each category, pulling figures from TDS certificates, Form 26AS, or the Annual Information Statement (AIS).
Work out your foreign-source taxable income after allocable deductions.
Apply the formula: total US tax × (foreign-source taxable income ÷ total taxable income).
Take the smaller of the limit or the tax you actually paid as your credit for the year.
Carry any excess forward or back on Schedule B, filing one Form 1116 per category, and summarize everything on Part IV.
The credit lands on Schedule 3, line 1 of your Form 1040. TurboTax, H&R Block, and FreeTaxUSA all prompt for this, but double-check the category and country fields, since the defaults often assume you only have one country involved.
You claimed the US credit but never filed Form 67 (or Form 44) in India. These two filings don't affect each other. A missing Indian filing has no bearing on your US return, but if you also want credit recognized in India for US tax paid, that separate filing needs to happen by the end of the relevant assessment year. Your Indian TDS certificate doesn't match what you entered. Pull your Form 26AS or AIS and reconcile the exact rupee figures. Mismatches like this are a common trigger for IRS inquiry letters on returns involving foreign income.
You already filed your US return without claiming the Indian credit. File Form 1040-X and attach the Form 1116 you should have included the first time. You generally have three years from your original filing date to make this correction, so the window is usually still open.

There's no standalone late fee for Form 1116 itself, since it's filed along with your regular return. But the related failures cost real money. Underreporting foreign income risks the Section 6662 accuracy-related penalty, up to 20% of the underpayment. A non-willful FBAR miss can run up to $16,536 per report for 2026; a willful one can reach the greater of $165,353 or 50% of the account balance. Form 8938 non-filing starts at a $10,000 penalty, rising to as much as $50,000 after an IRS notice. On the Indian side, misreported foreign income under Schedule FSI can draw a Section 270A penalty of up to 200% of the tax involved.
Yes, but only up to your actual Indian tax liability, not the raw TDS figure if that turned out to be more than what you actually owed. Report the income on your US return, then claim whichever is lower: your actual Indian tax paid, or your Form 1116 limit.

Generally, no. NIIT sits in a separate part of the tax code that Form 1116 doesn't reach. A couple of ongoing court cases have allowed treaty-based NIIT credits under other countries' treaties, but whether that extends to India's treaty is still unresolved. Don't assume it applies on your current return.
